TERMS & CONDITIONS OF HIRE

It is the responsibility of the Hiree to ensure that during the hire period all possible steps are taken to avoid injury to users, or damage to the Equipment. Under no circumstances should anyone who is under the influence of alcohol, drugs or other intoxicating substance be allowed to use, or supervise the use of the Equipment – See Disclaimer Below

1. Confirmation of Booking: The Hire Agreement shall take effect once signed, or email correspondence has passed between B4 Bouncy Castles (B4) and the Hiree which confirms the booking.

2. Equipment: Includes all the Equipment referred to in the Hire Agreement.

3. Suitability of Venue: It is the responsibility of the Hiree to make sure the Venue is suitable for, and can accommodate the Equipment

4. User Liability: All Equipment is used entirely at the Hiree's own risk – see Disclaimer below

5. Deposit: B4 may require a 50% Deposit to be paid to secure the booking, or held as security against the Loss or Damage of the Equipment

6. Loss or Damage: The Hiree should check the condition of the Equipment at the time of delivery and record any fault on the Hire Agreement. B4 reserve the right to charge the Hiree for the cost of repair/replacement up to the Value of the Equipment, and may take legal action for recovery, to include costs, should the Hiree fail to make payment within 7days of demand

7. Late Cancellation Fee: The Hiree may cancel the booking without charge up to four weeks before the Hire Date. Where less than four weeks notice is given, B4 reserve the right to charge a Late Cancellation Fee based on 25% of the hire fee, increasing to 50% where less than two weeks notice is given. Where B4 has not required payment of a Deposit, payment of the Late Cancellation Fee is required and should be paid within 24hours of demand.

8. Adverse Weather: B4 reserve the right to cancel an outdoor hire on the Hire Date, if, at the agreed time for delivery, it deems the weather conditions unfit for the safe use of the Equipment. In such circumstances, B4 reserves the right to retain the Deposit. Where B4 has waived collection of the Deposit at the time of booking, payment must be made within 24hours of the Hire Date.

9. Cleaning: B4 reserve the right to charge for cleaning the Equipment at the rate of £25 per hour where it is found to be dirty, marked with face paint, or where glitter or sand are found to be on the Equipment. Where B4’s Toddler Playzone has been hired the Customer is responsible for bagging up the balls at the end of the hire period. Failure to do so will result in an additional charge of £10.

10. Delivery & Collection: B4 will endeavour to meet the agreed Delivery and Collection Times. However, B4 cannot be held responsible for late arrival due to circumstances that are beyond its control

11. On the Hire Date, the Hiree must ensure that:

a) Access to the Venue is available at the Delivery and Collection Times

b) Unless alternative arrangements have been made the Hiree must be present to take delivery and sign the Hire Agreement. Where the Hiree is not present, B4 may agree to an appropriate adult signing the Hire Agreement on behalf of the Hiree.

c) A safe electrical supply is available for use at the venue and located within 30m of the operating location for the Equipment

d) The Hire Fee: Unless paid in advance, the Hire Fee, or any balance due, is to be paid at the point of delivery

e) In the case of an outside hire, where the Event is being supervised by the Hirer, B4 will only inflate the castle on a flat area of grass located within a fenced garden or secure grounds that are not accessible to members of the public. The area of level grass must be free from any underground services (gas, electric, water etc), overhead cables, and trees/bushes. Note: B4 cannot be held liable for any damage caused to underground services that it has not been made aware of.

12. Delayed Access: Should access not be available at the agreed Delivery or Collection Times, B4 reserve the right to charge the Hiree for standing time at the rate of £25 per hour or part thereof.

13. Access: Where the Equipment needs to be delivered through a building, it is the Hiree's responsibility to ensure that any surfaces, fixtures or fittings are protected. B4 cannot be held liable for damage caused where inadequate protection measures have been taken

14. Tampering With Equipment: Once installed the Equipment must not be moved, interfered with, or used for any purpose other than that for which it has been designed.

15. Supervision: Except where B4 has agreed to supervise use of the Equipment, the Hiree is responsible for ensuring that those using the Equipment are supervised at all times by a responsible adult, and that all Equipment on hire is used in accordance with the Safety & Operating Instructions that form part of the Hire Agreement.

16. First Aid: The Hiree is responsible for ensuring that adequate first aid facilities are available at the Venue

17. Medical Conditions: Under no circumstances should anyone be allowed to use the Equipment if suffering from a back, neck, or other form of medical condition that may put them or other users of the Equipment at risk of injury

18. Control Measures: Except where B4 has agreed to supervise use of the Equipment the Hiree is responsible for putting in place appropriate safety measures to ensure safe use of the Equipment.

19. Subletting: No sub-letting of the Equipment is permitted

20. Adverse Weather: In the case of an outdoor hire, the Hiree is responsible for ensuring that the Equipment is not used during adverse weather conditions. Where conditions deteriorate to the point where continued use may result in personal injury, or damage to the equipment and/or property, then the inflatable Equipment must be deflated immediately and, in any event, must be deflated where wind speeds exceed 38km/h (Force 5). Re-inflation should not take place until weather conditions have improved and it is safe to do so. Upon re-inflation, all anchorage points must be checked and any water removed.

21. Licences or Permissions: The Hiree is responsible for ensuring that any special Licences or Permissions that may be required for use of the Equipment at the Venue have been obtained, and must ensure the Equipment is located withing a private function room or garden

22. Accidents or Injury: In the unlikely event of an accident occurring, the Hiree must immediately notify an Insurance Advisor and provide a detailed written report of the incident; including the name and address of the injured party, any witness, and details of any damage to property. Any injured party must seek professional medical assistance within 2 hours of the incident occurring.

DISCLAIMER

Except where B4 Bouncy Castles has agreed to supervise use of the Equipment as part of the Hire Agreement, the Hiree is responsible for the safe keeping of the Equipment from the point of delivery until collection, and will be held liable for any damage caused. Furthermore, the Hiree agrees not to hold Chris Mason and/or B4 Bouncy Castles liable for death, injury, loss or damage, and also agrees to save harmless and keep indemnified the aforementioned in respect of any actions or claims that may arise out of the use of the equipment hired. B4 Bouncy Castles strongly advise the Hiree to consider taking out their own third party insurance cover for the duration of the Hire period.
